Terms and Conditions for The Perfect Speech

Every individual of 18 years of age or older may participate in The Perfect Speech project, i.e. he or she may contribute by writing statements, collecting statements, organizing a event for the project in their town and collect statements from the audience. The contributions may be written and published in any language.

Once a statement has been entered it cannot be changed. The author may, however, request the deletion of his entry at any time.

Any author of an entry is obliged to state truthfully all required information and declare his agreement with these rules before entering his or her text. The Perfect Speech project will not disclose any personal information to third parties and will use it only in order to contact the author.

All authors are bound to write their own texts. These texts should be the products of their own thoughts. Copying texts from other sources of any kind is forbidden. The Perfect Speech project has the right to contact any author directly by e-mail if their entry is suspected to violate a copyright or an exploitation right.

The legal right to the entered texts is transferred to The Perfect Speech project by virtue of the author's participation. This right includes the author's authorization to use his or her written texts in exhibitions, on the Perfect Web site, and all forms of publishing. Furthermore, it includes the author's authorization for The Perfect Speech to translate his or her texts to be used in the final product, the speech that will be given to all 2008 Presidential candidates. The right of utilization includes the use of the text for printed media such as magazines, newspapers, etc. It also includes the use of the text for all purposes of the project (publication on the Internet and in the form of a book, in any language and worldwide) as well as for the marketing and promotional purposes. Any author's text may also be used and published by The Perfect Speech project outside of the website www.the-perfect-speech.com, and the Perfect Speech project has the right to let third parties use any of the author's texts. However, the author retains the right to proliferate and exploit his own texts. The authors of submitted texts agree, in accordance with the purposes of The Perfect Speech project, to the above Terms and Conditions.

Any opinion may be freely expressed. All participants may write whatever they have to say. Unlawful statements, however, are not admissible, in particular such statements that are subject to legal proceedings (offences, incitement of the people, threats, revilement/abuse, racist remarks or statements, etc.). Not admissible, furthermore, are any remarks or statements that are fascist, anti-Semitic, politically extremist, obscene, etc. Equally inadmissible are all advertisements in any form, allusions and references to phone numbers, e-mail addresses and URLs as well as any general statement that may violate the law; in particular, this includes statements that contain false allegations or expressions of opinion that are unlawful or because they infringe on personal issues, religious beliefs, or because they violate basic human rights.

Texts that are entered and that do not fulfill the applicable criteria may be deleted by The Perfect Speech project without prior notification of the author. However, The Perfect Speech project is not under obligation to delete such texts. It is not possible for The Perfect Speech to assure the conformity of all texts submitted. In the case of violation of these Terms and Conditions and if such a violation is detected, the entry will be deleted and cannot be published, and the author is not entitled to a reimbursement of any fees paid.

The Perfect Speech project assures the freedom of press and the freedom of art. The contents of The Perfect Speech project are the authors' products and are neither systematically reviewed nor edited by The Perfect Speech project, however, the inclusion of the submissions in the final product is the sole decision of The Perfect Speech staff. The artistic and editorial concept of this project does not lend itself to a systematic examination or censorship.

Each person entering a statement to The Perfect Speech project is himself or herself fully responsible for that entry’s content. The Perfect Speech project declines all responsibility and assumes no liability for the contents of unpublished texts. In no event shall The Perfect Speech project be required to use any submissions that will hold The Perfect Speech staff or Lowell Darling Projects, LLC, liable for any indirect, special, incidental, punitive, or consequential damages arising out of, or related to, any activity in connection with The Perfect Speech project, regardless of whether such damages arise in contract, tort, under statute, in equity, at law, or otherwise.

As a rule, entries/opinions that are non-compliant with these rules cannot be published in The Perfect Speech project and may be deleted from the website www.the-perfect-speech.com at any time.

In the case where an entry violates the rules, The Perfect Speech project will erase the text immediately. If a justified challenge occurs as a result of this action, a complaint can be filed with the form provided herein. Such complaints can be submitted directly and anonymously.

All entries that are compliant with the rules will become useable content in the final product: The Perfect Speech, which will not be completed until June of 2008. The Perfect Speech retains the right to make the final decision regarding the final content of The Perfect Speech.

The last possible date to submit an entry for inclusions in the final version of The Perfect Speech is March 1, 2008. At that point the results of the submissions will be compile and draft made of the final version. This speech will be posted on The Perfect Speech web site.

The Perfect Speech will be sent to all official candidates for President of the United States following the June, 2008, Primary Election. At that time the results will also be sent to the media and be exhibited in various art venues around the globe. We will attempt to notify all participants of these publications and exhibitions, but we will not be held accountable for overlooking any of the participants due to address changes and other unforeseen events.

The sole place of jurisdiction for disputes in connection with this relationship is Santa Cruz, California, 95060 (USA).
